By booking our services, using our website, or engaging with our business, you ("Customer," "you," "your") agree to be bound by these Terms.

    We provide mobile entertainment services including:

    • Mobile game theater experiences

    • Virtual reality parties

    • 360 photo booth rentals

    • Laser tag events

    • Event support and game coaching

    All services are subject to availability and confirmed booking. Service descriptions on our website are for general information and may vary based on your specific package.

    3. Booking and Reservations

    • A valid credit or debit card is required to secure your reservation

    • A deposit may be required at booking to hold your event date

    • Final payment is due as specified in your booking confirmation (typically before or at the event)

    By Company: We reserve the right to cancel or reschedule services due to:

    • Severe weather conditions (lightning, flooding, high winds)

    • Equipment failure or safety concerns

    • Force majeure events (natural disasters, pandemics, government orders)

    If we cancel, you will receive a full refund or the option to reschedule at no additional cost.

    6. Rescheduling

    • Rescheduling requests made more than 7 days before your event: No additional fees (subject to availability)

    • Rescheduling requests made within 7 days of your event: $75 rescheduling fee and subject to availability

    • Rescheduling due to severe weather initiated by us: No fees

    9. Damage and Liability

    Customer Responsibility:

    • You are responsible for providing a safe, suitable location for our equipment and staff

    • You are liable for any damage, theft, or loss of our equipment during your event

    • Damage or loss will be charged to the payment method on file at replacement cost

    • You must ensure adequate space, level parking, and safe access for our mobile units

    Company Liability:

    • We are not responsible for property damage resulting from your request to position equipment in a specific location

    • We assume no liability for injuries sustained on your property or event location

    • All responsibility for guest safety, injuries, and property damage rests with the Customer and/or event host

    • Our liability is limited to the amount paid for services

    10. Parking Requirements

    Our mobile game theater requires:

    • A level, flat parking spot with at least 60 feet of clearance

    • Hardened surface (concrete, asphalt, or compacted gravel) to prevent equipment damage

    • Neighborhood street parking may be used with prior notice to neighbors

    • Do not disconnect our truck from the trailer without written approval

    • We prioritize safety for all persons, property, and equipment

    11. Severe Weather Policy

    Safety is our top priority. We reserve the right to reschedule or modify services in the event of:

    • Lightning or thunderstorms

    • Heavy rain, snow, or flooding

    • High winds or tornado warnings

    • Other hazardous weather conditions

    If we reschedule due to weather, no cancellation fees apply. Customers are encouraged to contact us in advance if adverse weather is expected.

    12. Parental Supervision

    • Parents or responsible adults must be present and within contact of our Game Coach at all times for guests aged 16 and under

    • Guests under 7 years old must have a parent or responsible adult inside the game theater at all times

    • While we accommodate parental preferences on game content, parents/guardians are ultimately responsible for monitoring their child's gaming choices

    13. Game Ratings and Content

    We offer a wide range of games with various ratings (E, E10+, T, M). We will make every effort to honor your requests regarding game content and ratings. However:

    • Parents and guardians are responsible for monitoring their child's gaming sessions

    • During large events, constant monitoring by our staff may be challenging

    • We encourage clear communication about content preferences before your event

    • We are not liable for exposure to game content that parents find objectionable

    14. Food and Drink Policy

    To maintain cleanliness and protect equipment:

    • No food or drinks are allowed inside the mobile game theater

    • Food and beverages may be enjoyed in designated outdoor areas

    • Customers must dispose of waste responsibly

    • Exceptions may be made for special circumstances with prior written approval

    • Violations may result in additional cleaning fees

    15. Alcohol and Drugs Policy

    Alcohol:

    • Alcohol may be served at events, but a security surcharge and/or deposit may be required

    • We reserve the right to refuse service, cancel, or end any event where alcohol creates safety concerns

    • Intoxicated guests may be denied access to equipment

    Drugs:

    • Illegal drug use is strictly prohibited at all events

    • Any violation will result in immediate event termination without refund

    • We will contact law enforcement if necessary

    16. Gratuity Policy

    Tipping our Game Coaches is voluntary but greatly appreciated as recognition of exceptional service. Tips may be given in cash or digitally at your discretion. There is no required amount. We ask that all guests treat our staff with respect and courtesy.

    17. Internet Connectivity

    Our Game Coaches will make every effort to provide stable internet connectivity. However:

    • We cannot guarantee internet availability at all locations

    • If connectivity issues arise, we will focus on offline games to ensure an enjoyable experience

    • No refunds will be provided for internet connectivity problems

    • We recommend notifying us in advance if your location has known connectivity issues

    18. Photography and Social Media

    Our Coaches may take photos during your event for promotional use on our social media pages (Facebook, Instagram, TikTok, YouTube). Photos will be available for viewing and downloading.

    Opt-Out: If you do not want photos taken or posted, please inform the Game Coach before your event begins.

    By attending our events, you consent to being photographed and having your image used in our marketing materials unless you opt out.

    19. Intellectual Property

    All content on our website, including logos, images, text, and graphics, is the property of Next Level Gaming Experience, LLC and protected by copyright and trademark laws. You may not use our content without written permission.

    20. Limitation of Liability

    To the fullest extent permitted by law:

    • Our total liability for any claim arising from our services is limited to the amount you paid for those services

    • We are not liable for indirect, incidental, consequential, or punitive damages

    • We are not responsible for injuries, property damage, or losses occurring outside the scope of our services

    21. Indemnification

    You agree to indemnify and hold harmless Next Level Gaming Experience, LLC, its owners, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

    • Your negligence or misconduct

    • Injuries or damages occurring at your event location

    22. Force Majeure

    We are not liable for failure to perform our obligations due to events beyond our reasonable control, including natural disasters, pandemics, government actions, strikes, or equipment failure.

    23. Governing Law

    These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes will be resolved in the courts of Osceola County, Florida.

    24. Dispute Resolution

    In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If unsuccessful, disputes may be resolved through binding arbitration in Osceola County, Florida, under the rules of the American Arbitration Association.

    25. Severability

    If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

    26. Entire Agreement

    These Terms, along with our Privacy Policy and any booking confirmation, constitute the entire agreement between you and Next Level Gaming Experience, LLC regarding our services.

    27. Changes to Terms

    We reserve the right to update these Terms at any time. Changes will be posted on our website with a new effective date. Your continued use of our services after changes constitutes acceptance of the updated Terms.

  • Next Level Gaming and Entertainment Experience is not responsible for property damage resulting from the client's request to position the mobile gaming theater in a specific location. The client is liable for damages, theft, or loss of equipment during use, and Next Level Gaming and Entertainment Experience, LLC can charge the client accordingly. Next Level Gaming and Entertainment Experience, LLC assumes no liability for injuries sustained on the client's property or designated location; all responsibility for damages or injuries rests with the client and/or the host.

  • We impose a travel surcharge for locations more than 30 miles from our Harmony, Florida base to cover driver time and fuel costs. You can find detailed information about our service areas here. If you have questions or concerns, please contact our customer support team.

  • At Next Level Gaming and Entertainment Experience, our game theater is equipped to handle various weather conditions, but safety comes first. In cases of severe weather like lightning, heavy rain or snow, high winds, or flooding, we reserve the right to reschedule to ensure the safety of everyone involved. Customers are encouraged to contact us in advance if they anticipate adverse weather conditions, and we offer rescheduling, indoor venue options, or refunds as alternatives.

  • Next Level Gaming and Entertainment Experience requires parents or responsible adults to be present and within contact of the Game Coach at all times for guests aged 16 and under. Guests under 7 years old must have a parent or responsible adult inside the game theater at all times. While they aim to accommodate parental preferences on game content, it is ultimately the responsibility of parents or guardians to monitor their child's gaming choices.

  • The Food & Drink Policy for Next Level Gaming and Entertainment Experience's Mobile Game Theater prohibits the consumption of food and drinks inside the theater area to maintain cleanliness and equipment integrity. Customers may enjoy food and beverages in designated outdoor areas while responsibly disposing of waste. Exceptions may be made for special circumstances with prior approval, and adherence to safety and cleanliness guidelines is mandatory.

  • At Next Level Gaming and Entertainment Experience events and parties, alcohol may be served, but a security surcharge and/or deposit may be required. The company reserves the right to refuse, cancel, or end any event serving alcohol if necessary for safety. Drug use is strictly prohibited, and any violation will result in immediate party termination and potential legal action.

  • Next Level Gaming and Entertainment Experience tip/gratuity policy states that tipping game coaches is not required but greatly appreciated as a gesture of gratitude for exceptional service. Customers are encouraged to tip at their discretion, in cash or digitally, with no specific amount mandated. Respect and courtesy towards game coaches are emphasized, and feedback for improvement is welcomed.

  • Next Level Gaming and Entertainment Experience will make every effort to play games or game types allowed by the Party Host or Hostess, offering a wide range of game ratings and genres. However, parents and guardians are responsible for monitoring their child's gaming sessions if they choose to restrict certain content, especially during larger events where constant monitoring may be challenging. Next Level Gaming and Entertainment Experience encourages clear communication and active supervision to ensure that gaming content aligns with individual preferences and values.

  • Next Level Gaming and Entertainment Experience coaches will make every effort to provide a stable internet connection for parties but cannot guarantee its availability. In case of internet issues, the focus will shift to running a great event with offline games, and no refunds will be provided for connectivity problems. The goal is to ensure an enjoyable gaming experience regardless of internet access.

  • Next Level Gaming and Entertainment Experience's Mobile Game Theater parking policy ensures safe and convenient parking for their video game theater at events. We need level and flat spots or logical areas for parking, but may use neighborhood streets with prior notice to neighbors. Safety is our top concern, requiring a minimum of 60 feet of space, no disconnection of the truck without approval, and parking on hardened surfaces to prevent dangers to persons, property, or equipment.

  • During your party, our Coaches may take pictures inside the theater or during laser tag activities, which will be available for viewing and downloading on our Facebook Fan Page. If you don't want photos taken or posted, please inform the Game Coach before your event begins. We offer this service to help you capture your party moments.
